These Terms of Service ("Terms") govern your use of trailerracks.com (the "Site") and your purchase of products from Green Touch Industries ("GTI," "we," "us," or "our"), located at 100 Federal Hwy, Lake Park, FL 33403. By visiting the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.
1. Eligibility
You must be at least 18 years old, or the age of majority where you live, and able to form a binding contract to place an order. Our products are sold for shipment within the United States.
2. Products, Descriptions and Pricing
We try to describe and photograph our products accurately, but colors, finishes and appearance may vary slightly from what you see on screen. Prices, availability and specifications may change without notice. Some items are available in limited quantities, and we may discontinue a product at any time.
We may make mistakes in pricing, descriptions or availability. We reserve the right to correct any error, and to cancel or refuse an order affected by an error, even after you have placed it. If we cancel an order, we will refund any amount you paid for it.
3. Orders and Payment
Your order is an offer to buy. It is accepted when we ship it. We may refuse, limit or cancel any order, including orders that appear fraudulent, that exceed quantity limits, or that we suspect are placed for resale without our authorization. Please do not resell our products without our prior written permission.
Payment is taken at checkout through Shopify and its payment processors. Card details are encrypted and handled by the payment processor; we do not store full card numbers. You agree to provide accurate and current billing, shipping and contact information.
4. Shipping
We ship within the United States using FedEx and USPS. Orders ship within 1 business day. Shipping charges, delivery estimates, damage and loss reporting are described in our Shipping Policy, which is part of these Terms. Delivery dates are estimates, not guarantees.
5. Returns and Refunds
Returns, restocking fees, return shipping and refunds are governed by our Refund Policy, which is part of these Terms. If there is a difference between this section and the Refund Policy, the Refund Policy controls.
6. Limited Warranty
Our products are covered by the limited warranty described on our Warranty page, including its coverage, exclusions and how to make a claim. Nothing in these Terms is intended to limit any rights you have under the Magnuson-Moss Warranty Act or other applicable law.
EXCEPT FOR THE EXPRESS LIMITED WARRANTY ON THE WARRANTY PAGE, AND TO THE EXTENT PERMITTED BY LAW, OUR PRODUCTS AND THE SITE ARE PROVIDED "AS IS," AND WE DISCLAIM ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. Some states do not allow limits on how long an implied warranty lasts or the exclusion of certain warranties, so some of these limits may not apply to you. This warranty gives you specific legal rights, and you may have other rights that vary from state to state.
7. Installation, Use and Road Safety
You, the buyer and operator, are responsible for:
- installing the product correctly and following the instructions provided;
- inspecting the rack, locks, mounting hardware and your equipment before each trip;
- securing your equipment and load in compliance with all applicable DOT, state and local rules; and
- not exceeding the rated loads of the product, your trailer or your vehicle.
Our products are designed to help secure equipment. They do not guarantee against theft, loss, shifting or damage, and no lock or rack can prevent every incident. Improper installation, misuse, overloading or lack of maintenance may cause property damage, injury or death.
8. Limitation of Liability
TO THE EXTENT PERMITTED BY LAW, GTI AND ITS OWNERS, OFFICERS, EMPLOYEES AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST EQUIPMENT OR LOSS OF USE, ARISING FROM YOUR USE OF THE SITE OR OUR PRODUCTS. TO THE EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO A PRODUCT WILL NOT EXCEED THE AMOUNT YOU PAID FOR THAT PRODUCT.
Some states do not allow the exclusion or limitation of certain damages, so some of these limits may not apply to you. Nothing in these Terms limits liability that cannot be limited under applicable law.
9. Indemnification
You agree to defend and hold harmless GTI and its owners, officers and employees from claims, losses and reasonable costs (including reasonable attorneys' fees) arising from your breach of these Terms, your misuse of our products, or your violation of any law or the rights of another person.
10. Intellectual Property
The Site and its content, including text, images, designs, logos, product names and drawings, belong to GTI or its licensors and are protected by intellectual property laws. You may not copy, reproduce, reverse engineer or manufacture our products or designs, or use our content for commercial purposes, without our written permission.
11. Acceptable Use of the Site
You agree not to use the Site for any unlawful purpose; to submit false information; to introduce viruses or other harmful code; to interfere with or attempt to gain unauthorized access to the Site or its systems; or to use automated tools to scrape the Site or place orders. If you send us comments or ideas, we may use them without obligation to you, and you are responsible for their content. We may suspend or end your access to the Site if you violate these Terms.
12. Third-Party Links and Services
The Site may link to or use third-party sites and services, such as Shopify, FedEx, USPS, Google, Meta, TikTok and YouTube. We do not control those services and are not responsible for their content or practices. Review their terms and policies before using them.
13. Privacy

14. Governing Law and Venue
These Terms and any dispute relating to the Site or our products are governed by the laws of the State of Florida, without regard to its conflict-of-law rules. You and GTI agree that the state and federal courts located in Palm Beach County, Florida have jurisdiction over any such dispute, and you consent to venue there.
15. Severability and Entire Agreement
If any part of these Terms is found unenforceable, the rest will remain in effect. These Terms, together with the Shipping, Refund and Privacy Policies and the Warranty page, are the entire agreement between you and GTI regarding the Site and your purchases. Our failure to enforce any provision is not a waiver of it.
16. Changes to These Terms
We may update these Terms from time to time. The updated version will be posted on this page with a new "Last updated" date. Your continued use of the Site after a change means you accept the updated Terms. Orders are governed by the Terms in effect when you placed them.
